Conditions of Sale
BIDDER TO REGISTER - Prior to the Auction each bidder shall complete details
on a Bidders Register to be obtained from the Auctioneer's Clerk
HIGHEST BIDDER TO BE THE PURCHASER - The highest bidder for each lot shall
be the purchaser and if any dispute arises as to any bidding the lot or lots
in dispute shall be immediately put up for auction again at the last undisputed
bidding, or the dispute may be determined by the Auctioneer. The dispute must
occur before the next lot is offered. The resolution of the dispute is at the
sole discretion of the Auctioneer.
AUCTIONEER MAY REFUSE BID - The Auctioneer may, without giving reason or notice,
refuse to accept the bidding of any person or persons on any lot or lots.
VENDORS - The Auctioneer may bid on behalf of the vendor up to the reserve
price if any and may withdraw any lot from sale.
BIDDING PROGRESSION - The Auctioneer may at any time alter the bidding progression,
or refuse a bid that alters the bidding progression.
GST - All items are sold GST inclusive unless other marked. The invoice will
detail the Price, Hammer Price and GST (if any).
BUYER'S PREMIUM - All items attracted an 11% (inclusive of GST) buyer's premium,
which, at the close of the sale, will be added to the invoice for each lot purchased.
DEPOSIT - On the fall of the hammer the buyer of each lot shall, if requested
pay to the Auctioneers Clerk a deposit determined by the Auctioneer, in cash
or bank cheque. If a buyer has not registered prior to the auction he shall
give in writing his name and address to the Auctioneer or his Clerk. If any
buyer fails to comply with with any of these terms the lot or lots in respect
of which such failure is made may, if the Auctioneer deems necessary be put
up again and resold and the defaulter's bid shall not be taken again during
the sale. If upon resale a lower price is obtained for any such lots than was
obtained the first sale the difference in price shall be a debt due from the
buyer in default upon the first sale.
FAULTS OR MISDESCRIPTIONS - All lots are sold as they are and a sale shall
not be invalidated by reason of any defect or faults in any of the lots by reason
of any lots being incorrectly described in the catalogue or elsewhere or missing
parts or quantities, and neither the vendor nor the Auctioneer shall pay compensation
in respect of any faults or errors in description, parts or quantities.
LOTS AT PURCHASER'S RISK - Each lot shall be at the purchaser's risk from
the fall of the hammer and the purchasers shall pay, by cash or cheque (unless
prior arrangements have been made with the Auctioneer or his Clerk), for the
lot in full before delivery and the purchaser shall remove the lot or lots purchased
or as otherwise stated at his own expense within twenty four hours of the time
of the sale. The lots are at the purchaser's risk from the fall of the hammer
or time of sale, the vendor and Auctioneers reserve the right to restrict access
to any lots prior to payment in full for any lots. Title to the goods shall
not pass to the buyer until all payments are cleared through the Auctioneer's
bank.
TAXES - Where applicable the buyer shall pay any taxes or charge on any lot
or lots
RESPONSIBILITY FOR REMOVAL - The purchaser is wholly responsible for any damage
to property or injury to persons incurred during the removal of a lot or lots
purchased, including damage or injury caused by their agents or employees.
FAILURE TO COMPLY WITH TERMS - Upon failure to comply with the above terms
any money deposited in part payment shall be forfeited to the vendor, therefore
all expenses and the lot or lots shall be resold by public or private sale and
the deficiency (if any) arising upon the resale together with the expense shall
be made good by the defaulter at this sale.
TIME IS OF THE ESSENCE - Time shall be of the essence for the sale of any
lot.
PAYMENT TERMS - Payment for lot or lots purchased, including any other charges
or tax, shall be paid strictly by cash, certified cheque, EFTPOS or Credit Card
(Bankcard, Visa and Mastercard only). Credit Cards attract a 1.35% surcharge).
